Just put my claim in for when I ruptured my ACL a few years back playing Sunday League, they sounded canny confident on the phone and I get a cash payment of £250 as soon as my claim is approved, win or lose!

 

They'll be ringing to get more info shortly. Anyone got any idea of what they'll be after? Hospital treatment dates and such like do you think?

This is 100% true although the ad says in the last 3 years so I might have to amend the dates. Although on the website it doesn't say owt about in the last 3 years like.

 

I've got 3 metal screws in my left knee holding it together and in the cold it goes stiffer than Wacky's cock on Viagra. Like this morning got in to the car and struggled to apply the clutch it was that bad.

How did the injury occur like? Unless the other player was guilty of an absolutely horrendous tackle then I reckon you'd struggle-their defence would be that you consent to physical contact including foul play (to a non-malicious degree).

 

We're all going to need a Sunday League insurance policy on top of our subs if SMO wins his test case. Burn him tbh.

I can't remember who did it or who we were even playing. I can only remember it was some pitch up in Blyth so I'll just blame J69 for it I reckon.

 

What level of detail are you expected to be able to provide like? It's not the sort of thing I was gonna get a fucking police report from now is it!

 

And it wasn't until months afterwards that I was actually correctly diagnosed as having torn my ACL. Usless fuckas told me I'd got a bit of cartlidge floating in my knee so I kept on playing!! Fuck a claim for a bad tackle I'm going for an all out medical incompetence case against the NHS, just like Kanye West will be doing now no doubt against the US docs that killed his mam!

Medical evidence will nail the date of the injury (ie treatment received, which will be pertinent to the 3 year deadline) and theoretically you would claim off the other player . Your problems would of course be 1. finding him and 2. getting any money out of him, as even if liability was established then unless he has insurance for this kind of thing then he could no doubt turn out to be the proverbial 'man of straw.'

I don't think your chances will be great. If you play any form of football in the UK, you must sign a form (or your club will sign for you) saying that you accept all responsiblity for any injuries which may come your way on the field. The only way in which that can be overlooked is if it is felt that you tackle you suffered constituted assault or GBH, or if the referee was negligent (no case has ever been proven in football on this grounds in UK legal history). Might be worth a go, but I'd be surprised if you won.

Jurisprudence on the duty owed by the referee has been developed in rugby in the case of Smoldon v Whitworth iirc and it would apply equally to football.

Yeah thats the badger. The context was rugby but the legal principle that arises would be applicable to all organised sport. So eg in match where someone suffered an injury through a challenge which was effectively a proveable assault, that player would be liable. If you'd ref'd the match and you'd continuously let challenges of that nature go unpunished when it was within your power to stop it, then you'd also be liable as a ref.

 

Think amatuer ref's worries tend to be more about the playability of a pitch tbh..but then in those circs it's usually the council that'd cop for it vicariously under the Occupiers Liability Act. Theyve got the money after all. Thats why you see more and more games getting called off on eg a Weds/Thursday after bad weather, when by the Sunday the pitch is perfectly playable.

Surely your Sunday league is affiliated with the local FA? Their insurance covers players who are sued for causing injury (so basically they would pay out).

 

Bet there's a fair chance the policy is worded so that it doesnt cover them in the event that the challenge was effectively an assault tho. Which co-incidentally would be exactly the standard of challenge that'd need to occur for liability to be made out in the first place. So eg the policy is basically worthless.

 

Mainly you see players go through the criminal injuries compensation board. Dont think you'd get owt the way you're suggesting. Very rare anyway I'd imagine.

Perhaps it's just on a loss of earnings basis then. Limited liability re compensation (which is all theyre bothered about at the end of the day of course).
