Best justice system in the world eh? Yep, that's right - he was found not guilty. He lied through his arsehole, said my brother was blind drunk and threatening him so hit him in self-defence. Said that my brother does this all the time (Errrrr, evidence?) Made him out to be a drunken, lairy knobhead who he had no choice but to hit him first before he was started on.

 

So there's some advice for you folks. If anyone randomly walks up to you and smacks you so hard that your glasses break into your eyes and leaves you scarred for life then don't bother trying to do the right thing. Don't bother trying to ensure that your society is a better place without a violent, lying thug in it cos it won't work. Just mop up the blood, go home and say nothing. Because that's what he might as well have done.

 

Hate to say i told you so cath but when you said he had entered a not guilty plea I had a feeling this would happen. His solicitors would have advised him against it if they didn't think he had a good chance.

 

Could at least have gave the bastard a heavy fine.

 

They wonder why people take the law into their own hands :blink:

Sorry to hear that Cath. Sounds like your best bet now is what alex mentioned earlier - get someone paid to do the little twat over. Anything to make him think twice before he does something like this again.

Absolute fucking horse-shit but sadly all to common these days.

 

The problem is the jury have to pass judgement on what's put before them and they're not allowed to form any opinion on anything but the evidence put before them. Ergo, if the barrister doesn't do a good enough job (as was in the case I was sitting in on), it doesn't matter what you think, you can't find him guilty if the evidence isn't 100%

 

No doubt the judge would have on more than one occassion told the jury "innocent until proven 100% guilty" and "if you have any doubt, there is no doubt, you must find him not guilty".

 

Like I said, absolute bollocks, but unfortunately the people who do this shit tend to know how to beat the system. I'm not one to encourage vigilante attacks, but I hope he gets what's coming to him. Sadly, that'll probably link back to your brother and your family and it's something none of you need.

its far easier to just ruin their lives in a way that doesnt involve physical violence (at least not the sort that can come back on you).

I don't have the vocabulary to fully express my sadness at the result of this. If I could say something to make you feel better I would. Alas, words fail me :blink:

 

Doing him over is not going to work. It wouldn't take the police five minutes to suss out his 'enemies' and who might have motive to do it.

 

If only blood samples had been taken following the event, alchohol levels could have been deduced, thus ruling out this thug's argument of your brother being drunk.

 

Without witnesses to the assault, the case seems to have boiled down to his word against your brother's.

 

I'm sure that if the jury had the full facts put before them i.e. all you have told us, and the background of your brother - as well as any 'previous' the thug has (I'm guessing that the tosser does have 'previous' but it cannot be divulged to the jury these days ?) they would have come to a quite different conclusion.

 

All I can say is that I'm sad at the outcome and I'm glad your brother did not suffer more serious damage to himself.

 

As I'm a 'non-believer' I find it quite easy to hope that this neanderthal gets his just deserts in the not too distant future in a most painful, slow, agonising injury.

I didnt say it before, amid the jokey (and semi serious posts) but it is a terrible thing, in this case we all know that Cath wouldnt be making it up therefore we know the arsehole is guilty. So sorry to hear that it went the other way.

 

As for revenge though, something has to be done, regardless of the law these people cant get away with these things so sometimes it has to boil down to someone else doing the violence. As long as your bro and dad and everyone else has a good alibi ie have a family party. Then theres nowt they can do.

 

Also if you'd used Peasepuds witness scheme then this would have been sorted, a busload of internet football fans all passing at the time and then came forward afterwards.

What infuriates me about this is that having met Cath's bro he's a nice quiet lad who wouldn't harm a fly. At least that's the impression he gave me. 'Hard' of this bloke picking on him like.

The thing is that even if he was found guilty, as long as he doesn't have a previous record for this type of thing I doubt he'd have got much more than a slap on the wrist anyway, maybe 40 hours community service at a push.

 

I wouldn't bother looking to retaliate with violence either.

I think its the principle of the thing though, yes sentencing is shite but at least any sentence would be a victory.
