I'm after some advice - now I've seen plenty of these "Injury Lawyer" bollocks adverts on the TV but I thought I'd see if anyone had any actual experience rather that a fictional Mr/Mrs being awarded £X for this or that.

 

The water board had being doing some work at my mams place, I went to drop my Nanna off their & trying to get into my mams yard she fell & ended up falling into the hole the NW had dug & not covered properly. My Nanna went to lean on the rail they put up & it caved in so she fell.

 

Later that evening they came out and fixed everything up properly but obviously it was a bit too late. She got off lucky with some cuts & bruises as the hole was proper deep.

 

Basically we want to sue the water board because she could have died.

 

What's the best way to proceed?

According to solicitors secretary Mrs PL find a solicitor who specialises in personal injury and who will do it on "no win no fee", they'll give you a 30 mins consultation for nothing. Apparently these things take a long time, and harsh as it may seem if "all" your nan suffered was cuts and bruises it may not be worth all the bother in the long run. Maybe go to the water board direct first?

Aye - good shout. She's 83 like so it wasn't just the injury that's the problem. It could have been anything, that's the issue I suppose!

 

The difference between how they originally left it & the modification after we rang them was massive like. I'll maybe tell me Mam to give the water board a ring first.

Aye what PL was saying is spot on, if the injuries are little more than cuts there may not be much compensation to be had. Especially if they have come out and fixed the problem. I'd do what PL is saying and get a free consultation but unfortunately I wouldn't expect loads as these type of things look for actual harm rather than the potential damage that could have happened. Hope your gran is feeling better mind Tom, sounds like it was a scary incident for her.

She seems ok now like but obviously at that age the bruises go black, so she looked in a bad way. She was pretty shook up about t.

 

I appreciate they fixed it but they away it was initially left was awful, so even if we give them a kick up the arse not to do it again elsewhere it's worth flagging up.

 

It's just offensive they could be so laissez faire about a massive dangerous whole in the ground. Anything could have happened.

In your OP you say you want to sue the water board because she could have died. But she didn't die and wasn't seriously injured. There's little to compensate here.

 

I would complain to the water board but forget the legal route, which frankly seems fruitless to me. Also, the government has massively cut back on PI claims anyway. Hopefully at least these workers will get the kick up the arse they clearly need.

When did you get your claim out of interest?

 

For reference, my wife is a leading PI lawyer for one of the top companies in the north east. I also have had the misfortune of a close relative, a young teenage kid, suffering a catastrophic injury on public transport. Major life changing injuries for no fault of his own and he's not going to get much compensation. Why? Because he wasn't predicted to do well at school and get a well paid job anyway. His compensation reflects this. It's bullshit, but that's how it is.

 

So what compensation is a woman in her 80s with cuts and bruises going to get, considering she presumably doesn't work any more, and therefore, well, what is there to compensate?

 

I'd suggest it's you who is talking bollocks.

Cuts and bruises I'd say are more disabling to a woman of her age than somebody like you and me. She's suffered as a resultnof negligence, she'll be entitled to a payout of some kind. Telling her to just not bother is shit advice

But what monetary loss has she had? None. And that's how compensation works.

 

Obviously, by all means Tom's family should get legal advice. But my advice would be not to expect much from the system.

Aye, I hope she bounces back quick from it mate. I hope you didn't take what I said in anyway a defence of them (I don't think you did btw), I was more just preparing you for the sort of things they look at in these incidences which (in this circumstance unfortunately) as PL, and Renton also pointed out is actual injury and loss rather than what could have potentially happened.

 

The negligence they have shown is complete bollocks and it's definitely worth flagging up, but like I say from a legal standpoint the fact they've fixed the negligent work may be enough to shield them (I know it's no comfort to you or your family). It's definitely worth going spare with them, take a free consultation just to feel it out but it seems Renton knows this area better than I do.

 

I hope you get something out of it mate, or at the very least the dickheads that done the botch job get some repercussions.
